Article 5 - Water Bills

Section 1.

Bills will be rendered at regular intervals and are due and payable within ten days at the office of the Water Works.  In case of failure to pay any bill within ten days after presentation or mailing to the last known address of the customer, the supply may be shut off and the meter removed without notice to the customer.  Penalties for quarterly accounts will be applied to all quarterly customers with an unpaid balance thirty (30) days following the rendition of a quarterly bill.  Penalties for monthly accounts will be applied to all monthly customers with an unpaid balance as of the date of the following monthly bill.  The penalty rate is ten (10) per cent per annum.

Section 2.

The property owner of the premises supplied by the Water Works shall be responsible for the payment of all bills rendered therefor.  However, the Water Works may, upon written request of the owner, mail bills to and receive payment from the owner's duly authorized agent or tenant.  The payment of the water bill by the agent or the tenant shall in no way affect the property owner's ultimate responsibility for payment of all water bills.  Furthermore, the Water Works shall not be required to conduct a last owner's search to determine the record owner of the subject property.

Section 3.

A fee may be levied in accordance with the terms of Fee Schedule A where it is deemed necessary by the Water Works to:

A. Send a notice of service termination for either delinquency in payment or for violation of the Rules and Regulations and/or the Sanitary Code of the New York State Health Department.

B. Post notices in a multiple dwelling for service termination notice for either delinquency in payment or for violation of the Rules and Regulations.

C. Dispatch an employee to collect delinquent amounts due or incur other expenses to effect such collection.

D. Pump out a flooded meter pit in order to read, change or service a meter or inspect the condition of such meter.

Section 4.

All arrears for water, or other charges incidental thereto, are liens upon the property and will be certified each year to the Collector of Taxes in each of the member municipalities comprising the Westchester Joint Water Works for inclusion in the next tax levy as provided by law.
