Article 8 - Freedom of Information

The following regulations have been promulgated for the purpose of facilitating public access to the records of the Westchester Joint Water Works (WJWW) with said access governed by the provisions of NYS Public Officers Law Article 6, Freedom of Information Law ("FOIL").
 

Section 1.

Access to the records of the Water Works is available and will be provided in accordance with FOIL. Requests shall be conveyed in writing to the Public Records Access Officer, WJWW Business Director, who will review and make the initial determination of availability under FOIL and respond accordingly.  In the event that access to a record is denied in whole or in part, an appeal may be addressed to the Public Records Appeal Officer, WJWW General Counsel, in the same manner as the initial request for access.

Section 2.

Requests for inspection or copies of records shall be communicated in writing to the Public Records Access Officer and must include the requester’s contact information and a clear and detailed description of the records.  The written request for access to records of the Water Works, or an appeal of a denial of access, may be conveyed by: (a) hand delivery addressed to Public Records Access Officer or Public Records Appeal Officer (as applicable) at Westchester Joint Water Works, 1625 Mamaroneck Avenue, Mamaroneck, NY; (b) USPS mail or courier addressed to Public Access Records Officer or Public Records Appeal Officer (as applicable) at Westchester Joint Water Works, 1625 Mamaroneck Avenue, Mamaroneck, NY 10543; or (c) electronic means using the address wjwwfoil@wjww.com.  As an accommodation, a Public Records Inquiry Form is available in hard copy at the office of the Water Works or electronically by clicking the following link: Public Records Inquiry Form 

Section 3.

Records will be made available for an initial in-person inspection, upon request or at the discretion of the Public Records Access Officer, under certain conditions such as the volume or the format of the records requested.  In-person inspection of public records shall be available during the regular business hours of the Water Works, arranged in advance by appointment, at the office of the Water Works, 1625 Mamaroneck Avenue, Village of Mamaroneck, NY.  In the event that access to a record is denied, in whole or in part, the decision of the Public Records Access Officer may be appealed to the Public Records Appeal Officer as set forth herein.

Section 4.

In-person examination of original records is available only under the supervision of the Public Records Access Officer or a designated representative and in such manner as to safeguard the integrity of the records and minimize interference with the normal operation of the Water Works as reasonably determined by the Manager of the Water Works. 

Section 5.

Water Works records will be reproduced and provided in accordance with FOIL and upon payment of a fee as follows: (a) 25 cents per page for copies not exceeding 9x14”, (b) 30 cents per page for copies exceeding 9x14” but not exceeding 11x14” or (c) the actual cost of reproducing the record.
